And while most regulations are similar, they do vary by county, so we recommend you check with your local building and zoning office before starting your project.
Building a fence directly on your property line makes it a partition fence. Which creates legally shared installation and maintenance expenses for you and the adjacent property. State law governs these shared structures, presuming the fence benefits both neighbors. Generally requiring both parties to share the costs of construction, maintenance, and repairs. Georgia law requires a formal written notification from the property owner initiating the build to their neighbor before any work begins. Which should include details of the proposed fence, the cost estimate, and a proposal for shared costs. Often requiring a 30-day time frame for the neighbor to respond. If the neighbor agrees, the shared responsibilities need to be documented in writing to avoid future disputes.
If the neighbor declines to contribute their share, state laws provide a way for the homeowner building the fence to recover some of their costs, through small claims court. However, the neighbor can contest financial responsibility if they can demonstrate that there is no benefit to adding the fence to their property. If the neighbor disputes the fence for reasons such as placement, style, or height then the dispute must be resolved before the fence can be built on the boundary line.
